Terms of Use

1. About Freehold and these terms

The Freehold Client Portal ("the Portal") is operated by Freehold KiwiSaver Limited ("Freehold", "we", "us"), a New Zealand company (NZBN: 9429051390487).

By creating an account or using the Portal, you agree to be bound by these Terms of Use. If you do not agree, please do not use the Portal.

We may update these Terms from time to time. If we make a material change, we will give you at least 14 days' notice by email or through a notice on the Portal. Your continued use after changes take effect means you accept the updated Terms.

2. Definitions

  • Portal — the Freehold client portal at app.freehold.nz, including all its features and tools.
  • Freehold / we / us / our — Freehold KiwiSaver Limited (NZBN: 9429051390487).
  • Adviser — Damian Sligo-Green (FSP1011603), a financial adviser providing advice under Booster's licence.
  • Booster — Booster Financial Services Limited (FSP28287), the Financial Advice Provider licence holder.
  • You / your — the individual accessing or using the Portal.

3. Eligibility and your account

To use the Portal, you must be at least 18 years old. You may create an account using an email address and password or via Google sign-in. You are entitled to one account per person.

You agree to provide accurate, complete, and current information when you register and throughout your use of the Portal. You are responsible for keeping your login credentials secure. If you believe your account has been compromised, contact us immediately at support@freehold.nz.

We may suspend or terminate your account if we believe you have breached these Terms, provided inaccurate information, or used the Portal for any unlawful purpose.

4. How the Portal works

The Portal provides tools to help you understand your financial situation and KiwiSaver options. It is important to understand what these tools do — and what they don't.

  • Risk Profiler — helps you understand your general attitude to investment risk, placing you in one of five bands (Defensive to Aggressive). It does not recommend specific financial products.
  • Fact-find — collects your financial information (income, assets, liabilities, insurance, goals). This is data collection only, not advice.
  • Retirement Projections — mathematical simulations of your potential KiwiSaver balance at retirement, based on the information you provide and a set of assumptions about returns, inflation, and tax. These are not forecasts, guarantees, or recommendations.
  • Dashboard — displays your KiwiSaver balance and fund data sourced from the Booster API. This is factual information, not a recommendation.

None of the tools on the Portal constitute personalised financial advice as defined by the Financial Markets Conduct Act 2013. Personalised advice is only provided through a formal engagement with your adviser — not through the Portal's self-service tools.

Damian Sligo-Green (FSP1011603) is a Financial Adviser providing advice on behalf of Booster Financial Services Limited (FSP28287), which holds a Financial Advice Provider licence issued by the Financial Markets Authority.

5. Your obligations

When using the Portal, you agree to:

  • Provide accurate, complete, and current information.
  • Update your information promptly if it changes.
  • Keep your login credentials confidential and secure.
  • Use the Portal only for its intended purpose and in compliance with New Zealand law.
  • Not attempt to access other users' data or interfere with the Portal's operation.

6. Information you provide

When you use the Portal, you may provide personal and financial information including your name, contact details, income, assets, liabilities, insurance, goals, and risk tolerance.

Your data is protected by Row Level Security — you can only see your own data. Your assigned adviser can view your information to provide personalised financial advice. Freehold administrators may access data for platform maintenance and support.

7. Third-party services

We ensure our service providers are contractually bound to protect your data to standards comparable to the New Zealand Privacy Act 2020. For more detail, see our Privacy Policy.

8. Anti-money laundering

Booster Financial Services Limited is a Reporting Entity under the Anti-Money Laundering and Countering Financing of Terrorism Act 2009 (AML/CFT Act). Your adviser acts as an agent for Booster in meeting these obligations.

As part of the advice process, we may need to verify your identity before certain services can be provided — particularly before the implementation of any financial products. You agree to provide any information reasonably requested for this purpose.

Identity verification is not required when you create an account or use the Portal's self-service tools.

9. Communications

By providing your email address, you consent to receiving transactional emails related to your use of the Portal — including account confirmations, risk profile results, and meeting reminders. We will not send marketing emails without your separate consent.

10. Intellectual property

The Portal's content, design, and code are the property of Freehold KiwiSaver Limited. You may not reproduce, distribute, or create derivative works from any Portal content without our written consent.

You retain ownership of all personal information you provide through the Portal.

11. Cookies and tracking

The Portal uses essential session cookies to keep you logged in and secure. These are necessary for the Portal to function.

We do not use advertising, marketing, or analytics cookies. If this changes, we will update these Terms and notify you.

12. Availability and changes

We aim to keep the Portal available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Portal at any time without liability.

13. Limitation of liability

The Portal and its tools are provided on an "as is" and "as available" basis. To the maximum extent permitted by New Zealand law, Freehold is not liable for any loss arising from:

  • Your use of, or inability to use, the Portal
  • Reliance on information or tools provided through the Portal, including retirement projections and risk profiler results
  • The accuracy of fund data sourced from the Booster API
  • Delays or failures caused by circumstances beyond our reasonable control

Nothing in these Terms limits any rights you have under the Consumer Guarantees Act 1993 or the Financial Markets Conduct Act 2013.

14. Account closure and data retention

You may request to close your account at any time by contacting us at support@freehold.nz.

We are required to retain certain financial records for seven years under our regulatory obligations, even after your account is closed. After this period, your data will be securely deleted or anonymised. See our Privacy Policy for full details.

15. Dispute resolution and complaints

If you have a complaint:

  1. Contact us first — email support@freehold.nz. We will do our best to resolve it promptly.
  2. Booster's complaints process — if you are not satisfied, you can escalate to Booster Financial Services Limited, under whose licence your adviser operates.
  3. External dispute resolution — if still unresolved, you may refer your complaint to Financial Services Complaints Limited (FSCL), Booster's independent dispute resolution scheme:
  4. Financial Markets Authority — you can contact the FMA at fma.govt.nz if you have concerns about our conduct.

16. Governing law

These Terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.
